1. Acceptance of Terms

By downloading, installing, or using Karmic Compass ("the App"), you agree to be legally bound by these Terms & Conditions ("Terms"). The App is operated by Diksha Dutt (operating as KarmicCompass) ("we", "us", or "our") and is available at karmiccompass.app. If you do not agree to these Terms in their entirety, you must immediately cease using the App and delete it from your device. These Terms, together with our Privacy Policy, constitute the entire and legally binding agreement between you and Diksha Dutt (operating as KarmicCompass). "You" refers to the individual accessing or using the App.

2. Eligibility & Minimum Age

You represent that you meet the minimum age required in your jurisdiction. We apply a global minimum of 13. Some jurisdictions require higher ages (16 in EU/EEA member states under GDPR Art. 8; 14 in South Korea under PIPA; 14 in Canada under Quebec Law 25; 13 in Brazil under LGPD Art. 14; 13 in the UK under the ICO Children's Code). In India, users under 18 require verifiable parental consent under the DPDP Act before the account is activated. By using the App you confirm you meet your local minimum. If you are below the applicable minimum age in your jurisdiction, you must obtain verifiable parental or guardian consent before using the App. If you are between the applicable minimum age and the age of majority in your jurisdiction, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not perform proactive age verification beyond self-attestation at onboarding. If we learn that we have collected data from a user below the applicable minimum age without verifiable parental consent, we will delete that data promptly (see Privacy Policy §14).

3. Account Registration & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at app.karmiccompass@gmail.com of any unauthorised access or suspected breach. We are not liable for any loss or damage arising from your failure to protect your account. You may delete your account at any time from the Settings screen within the App. Upon deletion, your data is handled as described in our Privacy Policy.

4. Subscriptions & Billing

Certain features require a paid "Compass" subscription (product ID: com.karmiccompass.basic_monthly). Pricing, billing period, and trial availability are displayed by the Apple App Store or Google Play Store at the time of purchase and may vary by region. Subscriptions are processed and managed by Apple or Google (via RevenueCat). Your subscription auto-renews monthly unless cancelled. We receive subscription status events via a RevenueCat webhook, which updates your account tier in our database. We do not receive your full payment card details. We do not process payments directly. Subscription auto-renews monthly at the displayed price unless cancelled at least 24 hours before the end of the current billing period via your App Store / Google Play account settings.

5. Free Trial

New users receive an 11-day free trial of the Compass plan, beginning from the moment they complete their initial profile setup. No payment method is required and you will not be charged automatically at the end of the trial. During the trial, you have access to most Compass features, including Arya AI chat, Incognito Mode, Deep Memory, personalised insights, and language preferences. The following restrictions apply during the trial: • Arya conversations: up to 30 messages per day (Compass subscribers have up to 400 messages per day). • Summarise: limited to today's summary only (Compass subscribers can generate weekly, monthly, quarterly, 6-month, and yearly summaries). • Chat history: scroll-back through older archived messages and full chat history search are Compass-only features. When the trial period ends, the App will present a subscription offer. You must actively choose to subscribe to continue accessing the App's features. If you do not subscribe, your access to the App's features will be suspended until a subscription is activated. Each device is eligible for one free trial. If you have previously completed a trial on the same device under a different account, the trial period will not be available again on that device.

6. Cancellation & Refunds

You may cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation must be as easy as signing up — both platforms provide a self-service cancellation flow. Cancellation generally takes effect at the end of the current billing period and you retain access until then. Refund eligibility and processing are determined by Apple or Google, as applicable, under their respective refund policies. We do not process refunds directly. Please contact the relevant app store for refund requests. EU / EEA & UK — Right of Withdrawal (Consumer Rights Directive 2011/83/EU Art. 16(m) and UK equivalent): you have a right to withdraw from a digital service contract within 14 days of purchase without giving a reason. At the moment of your first paid charge, we will ask you to confirm in-app: "I want service to start now and I waive my 14-day withdrawal right once delivery is complete." We will store this consent with timestamp and policy version. Without this in-app confirmation, your 14-day withdrawal right under Art. 16(m) is preserved and you may exercise it by contacting app.karmiccompass@gmail.com. Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies rights or guarantees you have under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010) that cannot lawfully be excluded or limited.

7. Compass vs Trial — Feature Comparison

The App operates across two tiers: ── Trial (first 11 days after onboarding) ── • Arya chat: up to 30 messages per day (enforced server-side). • Incognito Mode: available. • Arya settings (language, tone, memory): available. • Summarise: today only. • Chat archive scroll-back: not available. • Full chat history search: not available. • AI context: up to 30 recent journal entries, full digest, 40-message conversation window. ── Compass (paid subscription) ── • Arya chat: up to 400 messages per day. • All summarise periods: today, 7 days, 30 days, quarterly, 6 months, 1 year. • Full chat archive scroll-back and search. • All features unlocked. Server-side rate limits apply to both tiers and cannot be bypassed by the client. Trial status is verified server-side against the trialStart timestamp stored in your account.

8. AI-Generated Content — Not Professional Advice

Arya is an AI-powered personal guide powered by Google's Gemini AI (via Vertex AI with fallback to the Gemini Developer API). All content Arya produces — including responses to journal entries, voice transcriptions, images, or chat messages — is for personal reflection and informational purposes only. Karmic Compass is NOT intended to diagnose, treat, cure, or prevent any physical or mental health condition or disease. Nothing in the App constitutes professional medical, psychiatric, psychological, therapeutic, legal, financial, or any other form of regulated advice. Never disregard professional advice or delay seeking it because of anything Arya has said. Always consult a qualified professional for serious concerns.

9. Not a Medical or Crisis Service

Karmic Compass is a personal wellness and self-reflection tool. It is NOT a crisis service, mental health treatment, emergency service, or substitute for professional care. The App includes a keyword-based safety feature that detects potential crisis-related language in your messages and responds with relevant helpline information personalised to your country. When triggered and you are not in Incognito Mode, a short excerpt of up to the first 100 characters of your message and a timestamp are stored in your cloud profile in a field called "crisisFlags". This is used solely to provide contextually appropriate safety follow-up in future sessions. This data is not shared with external agencies, emergency services, or any third party. If you are experiencing a mental health emergency, suicidal thoughts, or are in immediate danger, please contact emergency services (such as 112, 911, or your local equivalent) or a crisis helpline immediately. Do not rely on this App in any emergency situation.

10. Acceptable Use of AI Features

When using Arya or any AI feature of the App (including voice recording and image attachment), you agree not to: (a) rely on AI responses in emergencies or life-threatening situations; (b) attempt to use Arya to generate unlawful, abusive, defamatory, or harmful content; (c) attempt to manipulate, jailbreak, bypass rate limits, or exploit the AI system; (d) submit content that violates the intellectual property or privacy rights of any third party; (e) record or submit audio or images of third parties without their knowledge and consent; (f) use voice transcription or image analysis for any purpose other than personal reflection and journaling. All AI requests pass through our secure proxy server. Safety filters (BLOCK_MEDIUM_AND_ABOVE) are applied to all AI calls server-side. We reserve the right to restrict or terminate access to AI features for misuse.

11. Device Permissions

The App requests the following device permissions: • Microphone (required for voice features): When you tap the microphone button in the Journal or Arya chat, your audio is recorded on-device, encoded as base64, and sent to Google's Gemini API via our secure proxy for transcription. The audio file is deleted from your device immediately after the transcription request completes. Only the resulting text transcript is stored. • Camera & Photo Library (optional): Required only if you choose to attach a photo in Arya's chat. The image is resized on-device (max 1024×1024px, ~50% quality) and sent as base64 to Gemini Vision via our proxy. Images are not stored permanently on our servers beyond the scope of the chat context. • Face ID / Touch ID (optional): Used locally on your device only for Passcode unlock. Biometric data is never transmitted to us or any third party. The passcode itself is stored in your device's Keychain (iOS) or Keystore (Android). • Notifications (optional): If granted, the App schedules three types of local, on-device reminders: journal reminder, mentor check-in, and daily check-in. Notification bodies contain only generic copy — no journal text, chat content, or personal data. A background task runs at most every 12 hours to reschedule these notifications. No data is transmitted to our servers during this background process. Compass push notifications ("a letter from Arya") are delivered via the Expo Push Service to APNs (iOS) / FCM (Android) — see Privacy Policy §8. All permissions are requested at the point of use and can be revoked at any time from your device Settings. Revoking a permission disables the corresponding feature but does not affect other App functionality.

12. Data Export

The App provides an "Export Data" feature in Settings that generates a PDF report containing your journal entries, chat history with Arya, wellness summary, badges, and scores. The PDF is generated on-device from your locally cached data. If you choose to include an optional personalised letter from Arya, one additional AI call is made to Google's Gemini API using a journey summary (not raw journal text). The rest of the PDF requires no network calls. The exported file is unencrypted. We do not transmit or receive the exported file on our servers. You are solely responsible for the security and distribution of any exported file once it leaves the App.

13. User Content & Licence

You retain full ownership of all journal entries, notes, voice transcriptions, images, and content you create within the App ("User Content"). We do not claim ownership of your User Content. By using the App, you grant us a limited, non-exclusive, worldwide, royalty-free licence to process, store, transmit, and use your User Content solely to: (a) provide and operate the service; (b) maintain, secure, back up, and troubleshoot the service; (c) generate insights and AI responses you request (including analysis of text, voice transcriptions, and images you submit); (d) comply with applicable law; and (e) enforce these Terms. We do not use your personal journal content for advertising and we do not sell it to third parties. Your content is not used to train any AI model — ours or our sub-processors'. Vertex AI customer content is excluded from Google's model training per the Google Cloud Terms (https://cloud.google.com/terms/data-processing-addendum).

14. Prohibited Conduct

You agree not to: (a) use the App for any unlawful purpose; (b) reverse-engineer, decompile, disassemble, or attempt to extract source code; (c) use automated tools, bots, or scripts to scrape or extract data from the App; (d) impersonate any person or entity; (e) transmit harmful, abusive, defamatory, obscene, or infringing content; (f) attempt to gain unauthorised access to any systems, accounts, or data; (g) interfere with or disrupt the App, its servers, or network infrastructure; (h) attempt to circumvent server-side rate limits or subscription tier enforcement; (i) submit audio recordings or images of third parties without their informed consent; (j) use the App in a way that could harm other users or third parties.

15. Account Deletion & Data After Termination

You may delete your account via two routes: (a) In-app: Settings → Account → Delete Account (requires active login). This calls our secure Cloud Function which immediately deletes your account. (b) Email-based (if you cannot log in): contact app.karmiccompass@gmail.com or use the "Request Account Deletion" option. We send a 6-digit verification code to your registered email (valid 15 minutes); once confirmed, your account is queued for deletion. For abuse prevention on this locked-out endpoint, your IP address is SHA-256 hashed (truncated to 32 hex characters) and stored briefly to rate-limit OTP requests; the raw IP is never persisted. Both paths delete the following data from our active systems: all journal entries and chat messages (including archived chat history), AI-generated insights, reports, your user profile document, AI usage records, feedback submissions, AI-response reports you submitted, device trial record, and your Firebase Authentication account. Deletion is processed immediately upon confirmation. Residual data may persist in encrypted backup systems for up to 90 days before being purged from backup cycles. Certain financial and legal records may be retained longer as required by law. After deletion, your right to use the App ceases immediately.

16. Intellectual Property

All content, software, trademarks, logos, graphics, mindfulness audio tracks streamed from Firebase Storage, and other materials in the App ("App Content") are owned by Diksha Dutt (operating as KarmicCompass) or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from App Content without our prior written consent. Nothing in these Terms grants you any rights to our intellectual property beyond the limited licence to use the App.

17. Third-Party Services & Apple Schedule 2 EULA

The App uses the following third-party services: • Google Firebase (Authentication, Firestore, Storage, Cloud Run, Cloud Functions, App Check, Vertex AI / Gemini API) — core infrastructure. • RevenueCat — subscription management. RevenueCat uses your Firebase UID as its app user ID. • Sentry (Functional Software, Inc.) — crash and error monitoring. • Apple App Store / Google Play — distribution and billing. • Google Sign-In and Apple Sign-In — optional authentication. • Google Fonts CDN — app fonts loaded at startup. • Expo Push Notification Service (operated by Expo, Inc.) — relays push notifications to Apple Push Notification service (APNs, iOS) and Firebase Cloud Messaging (FCM, Android). • Gmail / Google Workspace SMTP (server-side only) — used to send account deletion verification emails. Apple App Store EULA — Schedule 2 §3.2 Recitals (Apple Paid Applications Schedule): The parties acknowledge that these Terms are concluded between Diksha Dutt (operating as KarmicCompass) and the end user only, and not with Apple Inc., and that Diksha Dutt (operating as KarmicCompass) (not Apple) is solely responsible for the App and the content thereof. The licence granted to you for the App is limited to a non-transferable licence to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. Diksha Dutt (operating as KarmicCompass), not Apple, is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. Diksha Dutt (operating as KarmicCompass) is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Diksha Dutt (operating as KarmicCompass), not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Diksha Dutt (operating as KarmicCompass), not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple Inc. will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof. Google LLC is not a party to these Terms and bears no responsibility for the App or any claims relating to it. Any claims relating to the App must be addressed to us, not to Apple or Google.

18. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components. AI-generated content — including voice transcriptions, image analysis, and text responses — is not guaranteed to be accurate, complete, or appropriate for your circumstances.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIKSHA DUTT (OPERATING AS KARMICCOMPASS, A SOLE PROPRIETORSHIP) AND HER LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF YOUR USE OF THE APP. OUR AGGREGATE LIABILITY IS LIMITED TO THE GREATER OF (A) TWELVE (12) MONTHS OF FEES YOU PAID US FOR THE APP, OR (B) US$100, EXCEPT FOR LIABILITY THAT CANNOT BE EXCLUDED UNDER YOUR LOCAL LAW — INCLUDING GROSS NEGLIGENCE, WILLFUL MISCONDUCT, DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, AND STATUTORY CONSUMER RIGHTS UNDER (FOR EXAMPLE) THE UK CONSUMER RIGHTS ACT 2015, THE EU UNFAIR COMMERCIAL PRACTICES DIRECTIVE, THE AUSTRALIAN CONSUMER LAW, AND THE INDIA CONSUMER PROTECTION ACT 2019. Some jurisdictions do not allow exclusion of certain warranties or limitations on liability — in those jurisdictions our liability is limited to the maximum extent permitted by law.

20. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Diksha Dutt (operating as KarmicCompass) and its affiliates, officers, directors, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your use of the App, your User Content (including any audio recordings or images you submit), or your violation of these Terms.

21. General Legal Provisions

Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Diksha Dutt (operating as KarmicCompass) regarding the App and supersede all prior agreements or understandings. Severability: If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity of the remaining provisions. Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor entity in connection with a merger, acquisition, or sale of assets, with notice to you. Force Majeure: We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, war, terrorism, pandemics, natural disasters, government actions, internet outages, or failure of third-party services (including Google Cloud, Firebase, or Gemini API). Counterparts / Language: These Terms are made in English. Translations, if provided, are for convenience only. In the event of conflict, the English version prevails, except where mandatory local law requires the local language version to govern.

22. Service Availability & Prohibited Jurisdictions

Karmic Compass is intended to be available globally. However, we do not actively market to or operate in jurisdictions that are subject to comprehensive sanctions or export controls (including countries on OFAC, EU, UN, or UK sanctions lists). By using the App, you represent that you are not located in, or a national of, any such sanctioned jurisdiction. We do not guarantee availability or compliance with local laws in every country. If local law prohibits or restricts your use of the App, you must comply with that law.

23. Governing Law & Dispute Resolution

Primary governing law: These Terms are primarily governed by the laws of India, and Diksha Dutt (operating as KarmicCompass) is the contracting entity. For users in India: disputes are subject to the non-exclusive jurisdiction of the courts of Chandigarh, India. For users in the EU / EEA: the courts of your country of residence have non-exclusive jurisdiction for consumer disputes, and mandatory consumer protection laws of your country apply regardless of this clause. For users in the United Kingdom: UK courts have non-exclusive jurisdiction for consumer disputes; UK mandatory consumer protection laws apply. For users in the United States: disputes will be resolved by JAMS arbitration under the JAMS Streamlined Arbitration Rules and the JAMS Consumer Minimum Standards of Procedural Fairness, seated in Santa Clara County, California. Each party bears its own fees, except as the JAMS Consumer Standards require us to pay filing fees over US$250. Class arbitration is waived; claims must be brought on an individual basis only. Delegation: questions of arbitrability (including the scope, enforceability, and formation of this arbitration agreement) are for the arbitrator, not a court. Severability: if the class-action waiver is found unenforceable in your jurisdiction, the entire arbitration clause is void as to that claim, which shall then proceed in court. Either party may seek injunctive relief in court for intellectual-property infringement. You have 30 days from first use to opt out of arbitration by emailing app.karmiccompass@gmail.com with subject "ARBITRATION OPT-OUT". EU / UK / India users: the arbitration clause above is subject to local consumer-protection law and you retain the right to bring claims in your local courts where mandatory law so provides. For users in Brazil: Brazilian courts have jurisdiction for consumer disputes under the CDC (Consumer Defence Code). For all users: nothing in this clause limits your rights under mandatory consumer protection laws in your country of residence.

24. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via an in-app notice or email at least 7 days before the changes take effect. Your continued use of the App after the effective date constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the App before the changes take effect.
